Terms of Service
By creating an account or using Lulu Grow, you agree to these terms. They explain what you can expect from us and what we expect from you.
Plain-language summary
You can use Lulu Grow to collect customer feedback via QR codes. You're responsible for what you put on the platform — don't break the law, don't spam, don't impersonate. We'll do our best to keep the service running, but it's a software product so it might occasionally have bugs or downtime. Either side can end the relationship at any time. Indian law governs this agreement.
1. The Service
Lulu Grow is a software-as-a-service platform that helps small businesses collect and route customer feedback. Specifically:
- You create an account and add your business(es).
- We generate a QR code per business that links to a public review-routing page.
- When a customer scans the QR, they pick "Good" (which redirects them to your Google review page) or "Bad" (which opens a private feedback form whose contents are visible only to you).
- We notify you via email and optional WhatsApp when complaints arrive.
2. Your Account
You agree to:
- Provide accurate information when registering.
- Keep your password secret and not share your account with others. You are responsible for all activity under your account.
- Be at least 18 years old and authorised to enter into this agreement on behalf of any business you list.
- Notify us promptly if you suspect unauthorised access.
We may terminate accounts that provide false information or repeatedly violate these terms.
3. Acceptable Use
You may not use Lulu Grow to:
- Solicit fake or paid-for reviews on Google. Our funnel does not block customers from posting Google reviews — it only gives unhappy ones a private channel first.
- Impersonate another business or person.
- Collect data from customers in violation of any applicable law.
- List businesses that engage in illegal activity or fraud.
- Spam, send unsolicited messages, or upload offensive logos / content.
- Reverse engineer, scrape, or attempt to extract source code or our API keys.
- Resell, sublicence, or rebrand the service without a written agreement with us.
- Attempt to bypass our security, rate limits, or subscription gating.
You retain ownership of the content you upload (business name, logo, settings). You grant us a non-exclusive licence to host and display that content as required to operate the service.
3.1 Customer feedback content
Feedback submitted by your customers belongs to you. We will never publish it, share it with third parties (other than the providers listed in our Privacy Policy), or use it for any purpose other than delivering the service to you.
4. Billing & Trial
- Free trial: new clients may opt for a 7-day free trial. No payment information is required during the trial.
- Paid plan: the Starter Monthly plan costs ₹199 per month (inclusive of any applicable indirect taxes unless stated otherwise on the checkout page).
- Payment processing: all payments are processed by Razorpay. By paying, you also accept Razorpay's terms.
- No auto-renewal lock-in: we do not store your card on file by default. Your plan extends only after you actively make a payment.
- Tax invoices: available on request.
5. Cancellation
- You may stop using the service at any time. Your account remains active until the end of any paid period; we will not charge you again unless you initiate another payment.
- To delete your account entirely (along with your data), email us as described in our Privacy Policy. Deletion typically completes within 14 days.
- Refunds are governed by our Refund & Cancellation Policy.
6. Suspension & Termination by Us
We may suspend or terminate your account, with or without notice, if:
- You materially breach these terms.
- Your use causes risk or legal exposure to us, our users, or our infrastructure.
- We are required to do so by law.
- Payment fails and is not resolved within 7 days.
If we terminate your account for breach, no refund is owed. If we terminate for any other reason, we will refund the unused portion of your last payment on a pro-rata basis.
7. Service Availability
We aim to keep Lulu Grow available around the clock but do not guarantee uninterrupted service. Maintenance, bugs, third-party outages (Razorpay, Twilio, Anthropic, our hosting provider), and force-majeure events may cause downtime. We do not offer a contractual uptime SLA on the Starter Monthly plan.
8. Disclaimers & Limitation of Liability
The service is provided "as is" and "as available." To the maximum extent permitted by law:
- We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We are not responsible for outcomes that depend on third-party platforms (e.g. how Google ranks your business, whether a customer chooses to write a Google review, or whether a WhatsApp template gets approved).
- Our total liability for any claim arising out of or related to the service shall not exceed the total amount you paid us in the 12 months preceding the claim.
- We are not liable for indirect, incidental, consequential, or special damages — including loss of business, loss of revenue, loss of reputation, or loss of customers — even if advised of the possibility of such damages.
9. Indemnification
You agree to indemnify Lulu Grow and its operators against any claim, loss, or expense arising from your use of the service in violation of these terms or applicable law.
10. Changes to These Terms
We may update these terms from time to time. The "last updated" date at the top will reflect any changes. Material changes will be communicated to active clients by email at least 14 days before they take effect. Continued use of the service after a change means you accept the updated terms.
11. Governing Law & Disputes
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in the registered state of the business operating Lulu Grow. Before initiating litigation, both parties agree to make a good-faith attempt to resolve disputes via written communication for at least 30 days.
